Public Law

ZBV’s Public & Regulatory Law Area advises and represents national and international clients on a whole range of local Constitutional, Administrative and Regulatory Law matters.

One of our main strengths lies in the deep knowledge not just of local laws and regulation but also of regulatory practice and custom, which we have developed over years of providing services to the most demanding clients on complex and innovative matters. This allows us to tailor solutions that are creative, practical and effective while at the same time streamlining processes, times and costs of implementation involved.

Another distinctive feature of our team is the ability to fully and quickly grasp the business goals and needs of our clients -from different countries or cultures- and provide services that address competently all those goals and needs in the Argentine context. Conversely, we are capable of translating into simple and understandable terms the often intricate aspects of Argentina’s laws, regulations and governmental practices and propose innovative courses of action that further our clients’ goals under those conditions.

We regularly advise international clients –mainly foreign investors focused on acquiring participations in Argentine companies or developing their own local operations-, multilateral financial institutions and local clients such as public utilities (gas and electrical energy transportation and distribution, railway operators, water and sewerage companies, etc.); public contractors (public works, professional services providers); specifically regulated industries (ports, conventional or renewable power generation, TMT licensees or providers, real estate developers, etc.), banks and financial institutions, publicly traded companies in locally regulated markets and general businesses subject to federal or local (provincial or municipal-level) regulations.

We also advise and represent clients before federal or local administrative authorities on issues related to procurement processes (competitive biddings, etc.) and infrastructure and services development such as public-private partnerships (PPP) and private initiatives.

In addition, we offer a full range of Public Law related litigation and conflict resolution services, which allows us to advise and represent clients before federal or local courts; arbitral panels under ICSID, UNCITRAL, ICC, LCIA and General Arbitration Tribunal of the Buenos Aires Stock Exchange rules (on issues stemming from the breach of Bilateral Investment Treaties guarantees to regulatory-related issues arising from public-private agreements) and administrative authorities and courts.
